AM Graphic Design Agency (the “Agency,” “we,” “us,” or “our”) is committed to maintaining the highest standards of confidentiality, integrity, and security in the handling of personal information. This Privacy Policy sets out the principles and practices governing the collection, use, disclosure, retention, and protection of personal information in the course of our business activities.

The Agency conducts its operations in compliance with all applicable Canadian privacy and data protection legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (as amended by Law 25), British Columbia’s Personal Information Protection Act(PIPA), and Canada’s Anti-Spam Legislation (CASL). Where applicable, the Agency also adheres to recognized best practices in data governance and information security.

In the course of delivering professional services, the Agency may collect personal information that is necessary for legitimate business purposes. Such information may include an individual’s name, business name, email address, telephone number, mailing or business address, and any additional information voluntarily provided in connection with a project or service engagement. The Agency limits its collection of personal information to that which is reasonable and necessary under the circumstances and ensures that such information is obtained through lawful and transparent means.

Personal information is used exclusively for purposes consistent with the provision and administration of the Agency’s services. These purposes include, but are not limited to, client communications, project management, preparation of proposals and invoices, delivery of design and digital services, maintenance of business records, and compliance with applicable legal and regulatory obligations. The Agency does not sell, lease, or otherwise commercialize personal information under any circumstances.

Consent to the collection, use, and disclosure of personal information is obtained in accordance with applicable legal requirements and may be express or implied depending on the nature of the interaction. By engaging the Agency’s services, communicating with the Agency, or providing personal information through its website or other channels, individuals are deemed to have consented to the handling of their information as described herein. In accordance with CASL, the Agency ensures that commercial electronic communications are sent only with appropriate consent, and all recipients are provided with a clear and effective mechanism to withdraw such consent at any time.

The Agency does not directly collect, process, or retain credit card information or other sensitive financial data. Any payment transactions are facilitated through independent third-party service providers, which are contractually and legally responsible for maintaining appropriate security safeguards and compliance with applicable data protection standards.

All personal information collected by the Agency is stored and maintained exclusively within Canada, utilizing secure infrastructure located in the Province of Ontario. In compliance with Quebec’s privacy legislation, the Agency hereby discloses that personal information of Quebec residents may be communicated or stored outside the Province of Quebec, but will remain within Canadian jurisdiction. The Agency ensures that such cross-provincial data handling is subject to appropriate safeguards, including contractual, technical, and organizational measures designed to ensure an equivalent level of protection.

The Agency has implemented robust administrative, technical, and physical security measures proportionate to the sensitivity of the information under its control. These safeguards are designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. Access to personal information is strictly limited to authorized personnel who require such access in the performance of their professional duties and who are bound by confidentiality obligations.

Personal information is retained only for the duration necessary to fulfill the purposes for which it was collected, or as otherwise required to satisfy legal, accounting, or regulatory requirements. Upon expiry of the applicable retention period, personal information is securely destroyed, anonymized, or otherwise rendered inaccessible in accordance with industry best practices.

In accordance with applicable legislation, individuals have the right to request access to their personal information, to request rectification of inaccurate or incomplete information, and to withdraw consent to certain uses or disclosures, subject to legal or contractual restrictions. Requests shall be submitted in writing and will be processed within the timeframes prescribed by applicable law.

Pursuant to Quebec’s Law 25, the Agency has designated a person responsible for the protection of personal information (the “Privacy Officer”), who is accountable for ensuring compliance with applicable privacy legislation and this Policy.

The Agency reserves the right to amend or update this Privacy Policy at any time in order to reflect changes in legal requirements, regulatory guidance, or business practices. The most current version of the Policy will be made publicly available and will supersede all prior versions.
